It depends. Different states have different scalping laws, for example Massachusetts its illegal to re-sell tickets for more than face value. Some states it is legal to sell a ticket for a certain amount over face value, new york state i think its 40 percent.

Are there loopholes?

Yes and No. Many states do not specifically prohibit charging a "service fee" and although that does defeat the purpose of scalping laws its not technically a violation of the law because you are not selling the ticket for more than face value instead you are selling the ticket at face value and then placing a Fee on the service.

Recently the patriots went to court against an online ticket seller and won. My suggestion is do not purchase Patriot's tickets at one of these online vendors, but I bought tickets to Buffalo vs New England at buffalo and had no issues.

Hope this helps.
