The NFL was the senior league. Essentially, they bought out the AFL and folded their teams into the existing NFL.
The AFC and NFC originally were rough approximations of the merged leagues. When the leagues merged, the NFC consisted entirely of teams from the "old" NFL. The AFC consisted entirely of the 10 teams from the AFL, plus the Colts, Steelers, and Browns, who agreed to split from the "old" NFL and join the new AFC to balance out the number of teams in each conference. When they merged, the NFL had 16 teams and the AFL had 10, so three teams needed to join the AFL teams in the new AFC to balance out the numbers.

Because the AFL teams merged, but the company was bought out. The NFL bought it and just
added the AFL teams to the league and expanded it. The AFC and NFC are just divisions of teams, the difference is rather meaning-less.

42 nailed it. The 3 teams that came from the NFL to the AFC were the Browns, Colts, and Steelers. As part of the merger, the NFL adopted a couple of old AFL thangs: Player names on jerseys and it moved the goal posts to the back of the end zone.

because the afl merged with the nfl, so they retain the nfl rights, if the nfl had merged with a afl then it would be the afl,

Because they are still 2 different leagues and that will never change. AFC is American Football Conference and NFC is National Football Conference.
